DMCA Policy

1. Filing a DMCA Notice

If you are a copyright owner or an authorized agent and believe that content on Poko infringes your copyright, please send us a DMCA takedown notice with the following information:

Your Contact Information:

  • Full name
  • Address
  • Telephone number
  • Email address

Identification of the Infringing Material:

  • A description of the copyrighted work you believe has been infringed.
  • The exact URL or location of the infringing content on our website.

A Statement of Good Faith:

  • Include a statement such as: “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”

Your Authorization Statement:

  • Add: “I swear, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”

Signature:

  • Provide your physical or electronic signature.

2. Response to DMCA Notices

Upon receiving a valid DMCA notice:

  • We will remove or disable access to the allegedly infringing content.
  • Notify the content uploader of the takedown request.
  • Provide the uploader with an opportunity to submit a counter-notification if they believe the removal was in error.

3. Filing a Counter-Notification

If your content has been removed due to a DMCA notice and you believe this was a mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

  1. Your contact information (full name, address, phone number, and email).
  2. Identification of the removed content and its location before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the content was removed in error.
  4. Consent to the jurisdiction of the Federal District Court for your region.
  5. Your physical or electronic signature.

4. Repeat Infringers

Poko reserves the right to terminate accounts of users who are found to be repeat infringers under the DMCA.
